 Immigration to the United Kingdom-Student
1) Who can come to the United Kingdom to study?

According to the Immigration Rules and Regulations, there is no age restriction as to the age of the applicant. As long as the person meets the criteria of studying in the United Kingdom, a student visa may be issued for the applicant and his/her dependent(s).

2) From which colleges or universities can a person receive admission/acceptance?

According to the Immigration Rules and Regulations with regards to studying in the United Kingdon, only colleges and universities which are registered with the United Kingdom Border Agency are acceptable for visa purposes.

3) How much is the applicant required to have to cover his/her studying costs?

Tuition fees for colleges and universities, accommodation and living costs are different from one institution and city to another.Duration of study and the lifestyle of the applicant are the other determining factors for this.

4) Can a student work while studying in the UK?

Yes, most students start a part time job and do a couple of hours per week. It is highly recommended that applicants in this category not be dependent on the money earned from work and should be financially established. Sometimes, permission to work should be obtained from the UK Border Agency.

5) Can the dependents of the students enter the UK?

Yes, According to the Immigration Rules and Regulations the spouse and the children (under the age of 18) of the applicant may enter the United Kingdom and may live here during the main applicants legal stay.

6) Can a student ask for an extension of the visa or he/she is required to leave the country?

The student visa may be extended for the applicant and his/her dependents if he/she meets the requirements for extension and is not in breach of the Immigration Rules. Therefore the applicant and the dependents are not required to leave the United Kingdom for the extension of their visas.

7) Can students apply for Indefinite Leave to Remain in the United Kingdom?

According to the Immigration Rules and Regulations students applying and studying for postgraduate levels may apply for Indefinite Leave to Remain in the United Kingdom should they meet certain criteria. They may switch to other categories and apply for a Variation of Leave. They may also apply for Indefinite Leave to Remain if they are in the Uk for a period of 10 years (legally).

8) Can students apply for a scholarship from the United Kingdom?

Yes, they may for instance apply for Chevening Scholarship which accepts applicants worldwide every year. Normally applicant should be an undergraduate with an average of at least 14 out of 20 with a good level of English.

 Immigration to the United Kingdom via HSMP
1) Does the applicant need to have the original documents at the time of applying?

Yes. Only the originals are accepted. Your application will be refused if you submit the copies. In cases when you are awaiting the graduation, a certificate on the university letterhead will be acceptable.

2) Do the dependents have to apply at the same time with the main applicant?

It is highly recommended that they all apply at the same time to avoid any delay or problem.

3) What is the difference between HSMP and the Work Permit?

The difference lies in the job offer. To apply under the HSMP programme, you are not required to have a job offer.

4) Do the dependents have to pay a separate fee for their applications?

Yes, they do. The dependents have to pay the relevant visa fees at the time of applying.

 UK General Highly Skilled Migrants
1) What is Highly Skilled Migrant?

A highly skilled migrant is a person that possesses certain skills or experience in a certain field. These skills including their attributes enables applicant to earn a certain number of points. 2) How many points do I need to qualify for the HSM Visa?

To qualify for General Higher Skilled Migrant Visa, the applicant must earn a minimum of 75 points in the attributes such as qualifications, previous earnings, UK experience and age. Applicant also must earn 10 points for English language ability and 10 points for maintenance and funds. Previous earnings are determined by the country the applicant was employed in most recently. Countries are grouped in five different bands. These bands determine how many points the applicant will receive for previous earnings. 3) Do I need a job offer before I can apply for HSM visa?

No, the applicant does not need an offer of employment to apply for HSM visa. However, if you have an offer of employment then the Home Office will process your applicant as an urgent applicant.

4) Can I apply for HSM visa if I am already in the UK?

It depends on your current visa status. If you are on a student visa, you are eligible to apply for HSM visa. If you are in the UK on a Working Holiday Maker visa you cannot apply for HSM visa.

5) Do I need to speak English?

Yes, if English is not the first language of your country, you need to demonstrate proficiency in English. The best way of demonstrating this is by passing the IELTS at Band Level 6.5.

6) Are there any other requirements?

Yes, the applicant must demonstrate the ability to continue the career in the UK and that the applicant can support himself/herself and the family. The applicant must also demonstrate an intention to make UK the main home.

7) If I am on HSM visa in the UK, Can my family members join me?

The family can join the HSM visa holder in the UK. The family can remain in the UK as long as the primary applicant is eligible to remain in the UK.
